THE LEGAL POCKET GUIDE TO: AMERICAN SHELLFISH LAWS AND REGULATIONS

Supranational Publishing Company has just published, THE LEGAL POCKET GUIDE TO: AMERICAN SHELLFISH LAWS AND REGULATIONS.  This book is the first in a series that address important and specific areas of concern in the aquaculture industry. This 79 page legal guide was written by Henry D. McCoy, II, Esq., author of the acclaimed legal and business treatise, American and International Aquaculture Law.  The guide is the first and only comprehensive legal publication covering the complex shellfish regulatory system.

Aquaculture is a "spawning" ground for technical, biological, genetic and environmental advances. For example, though the lowly oyster receives little attention, it was the triploid oyster which was the subject of the first ruling by the United States Patent Office on the patentability of living animals.  Indeed presentations of scientific persons in this field still read like science fiction.

The scientific and economic advances in the past decade, coupled with worldwide demand for increased production of protein containing foodstuffs, have led to a variety of "marriages" between aquaculture and the biotech industry, such as the development of intensive aquaculture systems, color additives for shellfish, advances in algal genetic research, advances in sex reversal and many more. These advances continue to trigger changes in equipment, need for new animals drugs, improved feeds less dependent upon natural fisheries' catches, better marketing and public perception. It can be cogently argued that in proportion to the amounts of research monies spent, aquaculture has returned a far greater return on investment "ROI" in business world parlance, than most other agriculture related research.

With the tremendous speed of change, legal conflicts appear likely to significantly increase over the coming years. The aquaculture coordinator, attorney, banker, shellfish farmer, investor, regulator, supplier, shellfish processor and concerned citizen should be prepared for more changes and revisions to the basics of the shellfish and aquaculture
processes and legal regulations than any other agribusiness.

The guide examines and explains federal and state regulatory structures regarding shellfish.  Among some of the important topics covered are, who has the legal ownership of shellfish, the role of the Interstate Shellfish Sanitation Conference, the organization of the NSSP-Model Ordinance.  Other major industry questions addressed in the treatise are: seafood safety considerations and Food & Drug laws that govern the use of drugs in shellfish aquaculture; packaging and labeling; how coastal zones and wetlands are regulated; state and Federal environmental legal considerations; how is the EEZ to be regulated; and more. The detailed summary of contents is available on the Supranational Publishing page of the web site www.transnewsco.com.
